Supreme Court Releases Marshal's Report of Dobbs Leak
The Supreme Court on Thursday released a report of the Marshal of the Supreme Court's investigation into the May 2022 leak of the Dobbs opinion. The Chief Justice assigned the task to the Marshal and her staff, who analyzed forensic evidence and interviewed almost 100 employees. The Marshal's team was not able to identify a person responsible for the leak by a preponderance of the evidence and determined that no further investigation was warranted regarding the “82 employees [who] had access to electronic or hard copies of the draft opinion.”
The investigation was independently reviewed by former Secretary of Homeland Security Michael Chertoff by invitation of the Chief Justice. Chertoff advised that the investigation was "thorough" and that he "cannot identify any additional useful investigative measures" that the Marshal and her team have not already undertaken or is not already underway.
