Government Seeks Dismissal in ‘Padilla v. ICE’

On June 3, the government filed a motion to dismiss in the case of Padilla v. ICE, a lawsuit brought by detained asylum seekers regarding the Trump administration’s practice of forcibly separating children from their parents. The motion argued the suit has been invalidated in light of Attorney General William Barr’s recent ruling in Matter of M-S-, in which he decided that immigration judges would not have the authority to conduct bond hearings in cases where respondents are seeking release from detention.
