Closing the MOU Loop: My PENNumbra Response to Andrew Kent on Why Boumediene “Rights” Don’t “Expire”
Back in early November, Ben and I blogged about Fordham Professor Andrew Kent’s provocative new essay, “Do Boumediene Rights Expire?,” which he published in “PENNumbra,” the online companion to the University of Pennsylvania Law Review. Although I offered some quick reactions to Andrew’s essay in my original post, I also noted that I had a longer response underway. That response is now out in PENNumbra, and available here. For those interested in deeper analysis of the legal issues raised by the MOU dispute, I hope both Andrew’s essay and my response provide useful fodder.
