Coming to you live from Guantanamo, via Fort Meade CCTV: the third day of the motions session in United States v. Al-Nashiri. As before, we’ll have blog posts up in the “Events Coverage” section, with links to the posts displayed below, too.
Judge Pohl is expected to call the session to order at 9 a.m. Among other things, today’s session should see argument on AE82, the defense’s motion to have commission proceedings made available to media outlets in addition to CCTV facilities like Fort Meade’s; AE86, the defense’s motion to withdraw charges based on an improper referral by the Convening Authority; and AE87, the defense’s motion to dismiss because the Convening Authority exercises the power of a principal “officer of the United States”—but without first being nominated by the President and confirmed by the Senate.
