El Fasteny Case Argued
The D.C. Circuit also heard oral arguments today in El Falesteny v. Obama, some sort of Guantanamo case that is kept so tightly under seal that even the subject matter of the appeal seems to be a mystery. The same panel that heard Gul/Hamad–Judges Tatel, Ginsburg, and Brown–heard today’s oral argument, which was closed to the public.
What we can say is that El Falesteny’s case was before Judge Walton in the district court and the petitioner filed the appeal sometime in the middle of last year. It doesn’t appear to be a merits decision. If anyone has any public information about this case, please let us know.
